These Terms of Service ("Terms") govern your use of www.widemerchantgroup.com, the Wide Merchant Group merchant portal, and the Wide Merchant Group mobile apps (together, the "Site"), operated by Wide Merchant Group and its affiliated companies ("Wide Merchant Group," "we," "us," or "our"). 1. Eligibility and Business Use
The Site and our products are intended solely for businesses located in the United States. By using the Site, you represent that you are at least 18 years old and are authorized to act on behalf of the business you represent. Our products are for business purposes only and are not offered for personal, family, or household use.
2. Nature of Our Products
Wide Merchant Group provides revenue-based business financing, including merchant cash advances, which are purchases of a portion of a business's future receivables and are not loans. Information on the Site is general and for informational purposes only. Nothing on the Site is an offer, commitment, or guarantee of financing. All funding is subject to review, approval, and the execution of a separate written agreement. If any part of these Terms conflicts with a signed funding agreement, the funding agreement controls.
3. Applications and Information You Provide
When you apply, you agree to provide true, accurate, current, and complete information and to update it if it changes. By submitting an application, you authorize Wide Merchant Group and its partners and service providers to verify the information you provide, obtain business and personal credit reports, review bank and processing statements, and contact third parties as needed to evaluate your application and service your account. Submitting false or misleading information may result in denial of your application or termination of your account.
4. Account Access

The Site may link to or use third-party services, such as bank verification providers (for example, DecisionLogic), app stores, and social media platforms. Those services are governed by their own terms and privacy policies. We are not responsible for the content, availability, or practices of any third party.
6. Communications Consent
By providing your phone number and email address, you consent to receive calls, text messages, and emails from Wide Merchant Group and its trusted business partners about your application, account, and related products, including messages sent using automated technology. Consent is not a condition of any purchase. Message and data rates may apply. You may opt out of text messages at any time by replying STOP, and you may opt out of other marketing communications as described in our Privacy Policy.

TO THE FULLEST EXTENT PERMITTED BY LAW, WIDE MERCHANT GROUP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE.

You agree to indemnify and hold harmless Wide Merchant Group and its affiliates, officers, employees, and partners from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or any information you submit.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts. Disputes relating to a funding agreement are governed by the terms of that agreement.
